Many of today’s technology-driven, electrification, and social media-obsessed adults don’t relate as much as I do to the joy of the wind in your face on a petrol-propelled motorcycle.

Their loss in my opinion.

But, for those who get it, they know that Harley-Davidson enthusiasts like to get together, get to know each other and do a lot of riding.

For those of us who live in Oregon, we clearly know that we have some of the best riding in all of the U.S., which means this year we get to share this gem of a state at a National H.O.G.® motorcycle rally.

I’m talking about the Oregon Volcanoes H.O.G. Touring Rally happening September 11-15th. For those unfamiliar with Oregon, it’s a perfect time of year for riding, with mild temperatures, little chance of rain, and the foliage season begins. Adding to that, the Pacific Northwest is increasingly known for its craft beer, coffee shops, vibrant music and food scenes which is reason by itself to visit the state.

The last time there was a National H.O.G. Rally — that was started out hosted in Oregon — was back in 2017 for the Lewis and Clark; The Expedition Returns. That ride basically followed in the footsteps of Lewis and Clark’s 1805 expedition in search of the Northwest Passage, from Seaside, Oregon to St. Charles, Missouri. 50 Rides, One Nation

It’s been my experience after attending a few National H.O.G. events, they are a class act.  The local dealers often host evening events and the route information and swag are of high quality.  In addition, the H.O.G. planners (Bill Davis • Rally Coordinator) make it very simple to participate and have a great experience!

At present, the Oregon Volcanoes Touring Rally has 190+ H.O.G. Members and guests registered.  Keep in mind, this isn’t a “group ride” where a couple hundred bikes depart simultaneously every day with a ride captain.  Riders are free to forge their own departure times and routes (with solid guidance on scenic location stops and daily endpoint events) while riding at your own pace.

The ‘Volcanoes’ rally will start on the eastside of Portland, OR with a ride along the Columbia River Highway to the scenic Multnomah Falls viewpoint. Traveling a little farther and it’s a picturesque view of Mount Hood, the first of eight volcanos on this ride. The tour will then head north to an active stratovolcano, Mount St. Helens in Washington State, at a viewpoint which is also one of the stops for the 10 Rides for ‘21 H.O.G. challenge.

You might recall that the 10 Rides for ’21 is an annual H.O.G. member challenge featuring 10 great destinations throughout the country, along with a recommended scenic route for each. At this rally, riders will also have the option of picking up one of the 50 Rides, 1 Nation H.O.G. challenge on the Columbia River Highway at the Vista House in Corbett, OR. That’s two H.O.G. challenge stops completed, in less than 100 miles into your rally! The tour will loop back around to the westside of Portland for the first night on the road with a hosted event at Paradise Harley-Davidson.

On day-2, the tour will pass through the Opal Creek Wilderness and have spectacular views of Mount Jefferson, Three Sisters and Mount Bachelor to the eastern side of the mountains ending in Bend, OR for a hosted party and meal.

On day-3, the tour takes the route west towards the coast and the cool breezes of the Pacific Ocean and the coastal community of Coos Bay. The tour will ride by Newbury and Mount Mazama Volcanos.

On day-4, the tour will ride by the Mount McLoughlin volcano and will visit Klamath Falls before ending the rally with a hosted meal, party and closing ceremony in Medford, OR.

There will be a total of five hosted stops planned at Harley-Davidson dealerships along the tour route. Check out the H.O.G. website if you’ve yet to register and want to join the tour HERE.

It should be a great Oregon tour, with a side trip into Washington and a riding route that provides twists and turns and follows many of the region’s noteworthy volcanos.

We all love our rides, but what about the dealers?

If you wander into the forums, they are full of comments ranging from the good, the bad and even the ugly.

Dealers stared into the teeth of COVID-19, mixed it up with the motor company’s revenue declines, layoffs, reduced bike inventory to bolster prices, which was followed by several dealers closing down including some Bar & Shield Circle of Achievement Award dealers, permanently.

We all know it’s been a tough 14-months and that includes every Harley-Davidson dealer along with their employees.

Adding to all of this, was corporate Harley-Davidson throwing out more strategy changes (“wired”) than I change my socks.  And when corporate management dictate the “We know what is best in/for your showroom” requirements — you know how it goes, all the risers need to be symmetrical, with the right merchandise on each one, perfectly priced, labeled, and “faced” toward the customer — the dealership owner has the choice to largely accept them or not.  If they don’t accept them, then the “widget guys” from Milwaukee can say … “No soup for you!

That’s when those inspirational corporate quotes like: “You’re here by the grace of your lineage” start to sound like marketing for the early Pilgrims.

But, I’ve digressed.

Be it clothing, parts or motorcycles, Paradise Harley-Davidson, has continued to provide what customers want. From the owner to the staff folding t-shirts and everyone in-between, they are part of our Northwest motorcycle community and they interact with us on a daily basis, selling the experience of coming to the dealership as much as of riding itself.

17-Year Anniversary Celebration

You might not recall, but it was not long ago when Harley-Davidson management forced, via franchise contracts, that dealers significantly upgrade or move and open up large “mega stores” on an interstate exit.  The corporate ethos was larger is better and location, location, location!  This mandate alone had a lot to do with dealers selling or going under in the late 90’s and early 2000’s.

The Paradise dealership has its roots grounded in Beaverton, Oregon, a small 7,000-square-foot store.  The store was mandated by its franchise “relationship” with Harley-Davidson to upgrade, however, they were in a very tight geographic footprint on SW Farmington Road.  If you lived or traveled through the heart of Beaverton you know that it meant only one thing — relocating to a new store. The then current owner determined that a new store was way too much to take on and decided to sell the dealership.

At the time, Ed Wallace who previously was with PACCAR, where he was a General Manager in the Kenworth Truck division was now one of America’s most successful and decorated Harley-Davidson dealers.  Wallace purchased the Tacoma dealership (Destination Harley-Davidson) in partnership with son, Ed Jr., and daughter, Christy, in 1995.  The Tacoma facility went from 7,000 to 50,000 square feet and is located just off I-5. Then in 1997, he acquired the Harley outlet in Silverdale, Washington. Christy was the majority owner of the Silverdale store and planned every detail of the expansion. Going from a 3,000-square-foot converted gas station on Silverdale Way to the newly constructed 20,000-square-foot $3 million building.

Having success in developing the motorcycle business and constructing large, multi-million dollar facilities, Ed Sr., purchased the Beaverton Harley dealer in 1999, and moved it to a new 30,000-square-foot Tigard facility, which Ed Wallace, Jr. managed.  Ed Jr., married his sweetheart from the Tacoma area and after 3+ years of running the Tigard facility, wanted to return to Tacoma.  As I recall, Ed Sr., had fully retired from the business by then, and Ed Jr., put the Tigard dealership on the market when Mike Durbin stepped in and bought it in 2004.  The name was changed to Paradise Harley-Davidson and the rest as they say is history.

On a local level, I like supporting small(er) businesses, vs. the mega-destination dealers i.e. Timpanogos in Lindon, Utah, which is one of the largest dealerships in the U.S. at 58,000 square-feet.  In my opinion, Paradise H-D has a loyal following and always a great place to visit, as they have something going on all the time. I’ve enjoyed and been working with Mel in the parts department since the good ‘ol Beaverton days! The staff gets to know the people that bought from them and for service you are never just a number that they need to get through the system! Don’t get me wrong, I still swallow HARD at some of the service pricing, but my personal experiences are of good people, good service and being treated fairly.

This past weekend Paradise H-D celebrated their 17th Anniversary.  I stopped to partake along with a few hundred or more other enthusiasts. They put on a great social event with a beer garden, live music, dunk tank, bikini bike wash, games, door prizes and more for their clientele.  What I really like is that no one talks about what you do for a living. They talk about what and where you ride.

Congrats Paradise H-D on 17-years as a standout dealership!

Concerns over ongoing restrictions forced the cancellation of the Hells Canyon Motorcycle Rally planned for July 9-12th 2021.

Organizers came to the decision due to the State of Oregon’s restrictions, and having no line-of-sight to a method of safely hosting this event while still being in compliance with the state’s guidelines. “The show must go on” is in our DNA, we are now working through the ramifications of this unfortunate situation.

I’m of the viewpoint that organizers likely made the decision that hosting an event for a few thousand people with mandated indoor/outdoor occupancy limits and social distancing requirements was too risky due to enforcement and liability issues. Additionally, the pandemic’s adverse impact on manufacturers and industry vendors has led to significant supply delays and shortages, which adds even more risk for small businesses.

Maybe in 2022…

Oregon Scenic Byways

You might have an image in your mind of what motorcycle riding through Oregon is like, and the truth is, it’s a compilation of adventures. The landscapes are incredibly varied from Martian-like vistas in the driest place to ecosystems with a staggering array of flora, fauna and fungi.

America’s Byways® is an umbrella term used for a collection of 150 diverse roads designated by the U.S. Secretary of Transportation. The road designation is typically based on their archaeological, cultural, historic, natural, recreational, and scenic qualities.  They are considered gateways to adventures where no two experiences are the same.

Oregon is fortunate to have 10 incredible roads as part of America’s Scenic Byways and whether a maiden voyage or seasoned adventurer, you can see a lot of Oregon from behind the handlebars.

Below are snapshots of each Oregon Byway:

Cascades Lakes

Cascade Lakes Scenic Byway — 66.0 mi
This byway cuts a path through the mountains, lakes, and forests of central Oregon. Volcanism and glaciation formed more than 150 lakes for which the region is well known. See outstanding examples of lava flows, alpine lakes, and meadows. Cross paths taken by such historic figures as Kit Carson.

 

Hells Canyon

Hells Canyon Scenic Byway — 218.4 mi
Journey from river’s edge to mountain top and down to valley floor. Savor panoramic views of rugged basalt cliffs and fertile fields, rimmed by snow-tipped peaks. Tour foundries, galleries, and museums. Touch the weathered track of the historic Oregon Trail. Watch the majestic Snake River tumble through North America’s deepest canyon.

 

Columbia River

Historic Columbia River Highway — 70.0 mi
Travel to magnificent overlooks that provide views of the Columbia River and waterfalls, including Multnomah Falls. Springtime has magnificent wildflower displays, including many endemic plants. The Columbia River formed the last leg of the Lewis and Clark Expedition and was part of the early route of the Oregon Trail.

 

McKenzie Pass

McKenzie Pass-Santiam Pass Scenic Byway — 82.0 mi
Experience dramatic views of the snow capped High Cascade Peaks. The panorama of lava fields and six Cascade peaks is made more striking by the contrast between the black lava and white snow. The mountains are mirrored in crystal-clear lakes, and the byway passes beautiful waterfalls, including Sahalie and Koosah Falls.

 

Mt Hood

Mt. Hood Scenic Byway — 105.0 mi
On this byway, volcanoes once erupted and mammoth floods scoured deep gorges. Discover geologic wonders, waterfalls, temperate rain forests and wild rivers. Explore pastoral valleys with farm-fresh produce. Experience the formidable last leg of the Oregon Trail, the Barlow Road. Enjoy this bountiful wonderland that the pioneers called “paradise.”

 

Outback

Outback Scenic Byway — 170.0 mi
“Outback” refers to land with a natural ruggedness. Though people come here seeking independence, they know each other’s first names. Community is paramount. Jonathan Nicholas, publisher of the Oregonian, said it is “a star-spangled landscape of marsh and mountain, of reflection and rim rock, of seamless vistas and sage-scented dreams.

 

Pacific Coast (North, Mid and Southern)

Pacific Coast Scenic Byway — 363.0 mi
Starting in Astoria and traveling south to Brookings, the Pacific Coast Scenic Byway provides views of amazing coastal scenery. The road winds by estuarine marshes, clings to seaside cliffs, passes through agricultural valleys, and brushes against wind-sculpted dunes. Charming small towns, museums, state parks, overlooks, historic bridges, and lighthouses ensure a delightful journey.

 

Rogue-Umpqua

Rogue-Umpqua Scenic Byway — 172.0 mi
From rolling, oak-covered hills to towering coniferous forests; from roaring whitewater rapids to incised inter-canyon lava flows; the Rogue-Umpqua Scenic Byway invites you to experience 172 miles of diverse river and mountain landscapes. Drive alongside the Upper Rogue and North Umpqua Wild and Scenic Rivers, both of which contain world-class fisheries.

 

Volcanic Legacy

McKenzie Pass Highway (OR242)

Oregon is home to a large network of highways and backroads, from rugged coastal headlands to deep old-growth forests, lush vineyard-lined valleys to lofty alpine passes, high-desert vistas to deep river canyons. The epic landscapes offer up motorcyclists everything from beginner to expert road diversity.

One such spectacular highway is the old McKenzie Pass Highway (OR242), which opened this week from it’s winter hibernation.

Assuming you start in Sisters, Oregon you’ll have about 8 miles of warmup of gently rising, mostly straight road as you head west past hay meadows and into the forest. Then you’ll take a 90-degree turn at McGregor’s Curve, and the elevation climb is on. The main ascent is over 5 miles, and you can settle into a rhythm as you take in the pine-scented air.  Unfortunately, you’ll also note the large wildfire destruction from the summer of 2017 that disrupted the forest and surrounding landscape.

Until the 1860s, the pass was an Indian trail that later became a wagon route (known as Craig’s McKenzie Salt Springs/Deschutes Wagon Road) for driving cattle over the Cascades.  As you emerge from the forest at Windy Point, you’ll get a nice view of Mt. Washington and can scan across a 65 square mile, 2,000-year-old black lava flow. You may want to stop to process it all and then continue on as the ascent travels serpentine asphalt between lava-rock walls just before reaching the summit.

The summit provides a unique view of the lava-rock-constructed Dee Wright Observatory (at 5,187 feet), which provides panorama views of the mountain landscape and Three Sisters Wilderness areas.

The 25-mile, 4,000-foot descent to Highway 126 is no “puff and fluff” ride as it snakes down tight corners and exhilarating switchbacks to the dense Cascadian forests over the McKenzie River. It’s a dramatic transition from the east side of the Cascades and is a billboard of the natural environment and defines the uniqueness of the region.

The highway speed limit is slow at 35mph to 45 mph in most places. The scenic views are well worth the extra time and should be on everyone’s ride list.

ODOT Traffic Volume Report

Did I shower today or was that yesterday?

When did this all start? February? That feels like ancient history.

March ended without March Madness. April started with Arizona Bike Week and the Laughlin River Run being canceled.  May graduations were canceled.  Friday happy hours have been called off indefinitely.  For those who still remain employed, but working from home, daily cues like commuting, rush hour traffic and socializing after work have disappeared

Workdays blur together, and weekends are just weekdays with fewer obligations. I know I’m not going out today so, it’s just, every day is today.

The good news…

On all major interstates in the Portland metro area, traffic is down 46% from levels last year, according to a report compiled by the Oregon Department of Transportation.

Interstates 5, 405, 84 and 205 are all seeing significant traffic declines. For example, average speeds on I-5 northbound during what used to be the afternoon rush hour were up to 60 miles per hour in the most recent week of figures. Back during the week of March 1, the average rush hour speed there was 33 mph.

I-5, in particular, is seeing the most significant declines of metro-area freeways. The average weekend traffic was down 64% for the most recent full week of data available (March 30-April 5). State officials compiled the data from 38 traffic monitoring locations across 13 freeways and highways in Oregon.

The number of car crashes has plummeted due to lower traffic volumes.  However, evidence is beginning to emerge that absent traffic jams during the coronavirus crisis, many drivers are getting more reckless.

Speaking of reckless…

Pavel Vasilyevich Krechko

The latest example in Portland, Oregon happened on Tuesday, April 14, 2020 at 3:34 p.m., East Precinct officers responded to the intersection of Southeast 148th Avenue / Southeast Powell Boulevard on a report of a traffic crash involving a motorcyclist.

Investigators learned that the suspect, Pavel Vasilyevich Krechko (19-year-old), was involved in a minor traffic crash on Southeast Powell Boulevard just west of Southeast 148th Avenue and was fleeing from that traffic crash when he then crashed into a motorcycle head-on killing Brandon Cody Reid (32-year-old).

Krechko, fled the scene immediately (a 2nd time!) after the crash and abandoned his vehicle.  Investigators responded to Krechko’s residence in Troudale, Oregon where he was taken into custody about an hour later. Krechko initially denied being involved in either crash, and said his car had been stolen a few hours earlier. But, police said he eventually confessed to crashing and fleeing both scenes.

Krechko was arrested and booked into the Multnomah County Detention Center on one count of Manslaughter in the Second Degree, one count of Failure to Perform the Duties of a Driver (felony), one count of reckless driving, and one count of Failure to Perform the Duties of a Driver (misdemeanor).

Now for the MOST important part of this post, which should wipe away that stupid smile on Mr. Krechko’s booking photo!

Senate Bill 810 became effective January 1, 2020.  It was signed into law back in June, 2019, and modifies the definition of “vulnerable user of a public way” to include persons operating or riding on a moped or motorcycle.  The law (801.608, “Vulnerable user of a public way”) enhances penalties for motorists who kill or injure motorcyclists, as well as other vulnerable road users such as pedestrians, highway workers or bicyclists.

It is very distressing to write about this type of idiotic negligence.  My hope is that Oregon taking this important step to protect motorcycle riders by significantly enhancing the penalties against careless and criminally negligent drivers will slow down people making bad choices.

Blue Mountain Scenic Byway

The Oregon Department of Transportation is responsible for furnishing and maintaining directional, regulatory, warning, and informational signing on the state highway system.

Can you explain the significance behind every color and symbol used in Oregon’s road signs?  How about the inspiration behind the center line that has divided roads for decades?

ODOT Signs

It was interesting to learn, that the first modern centerline was painted in 1917. White was chosen by its designer, Edward Hines, who was inspired after seeing milk spill from a delivery wagon on a newly-paved road.  In 1935, highway officials gave local governments options when it came to painting centerlines. They could be either yellow, white, or black, depending on the color of the underlying pavement. By 1955, 49 states had adopted white stripes to divide their traffic lanes.  The ONLY holdout, Oregon, who preferred yellow, arguing that it was safer.

The federal government balked at such a ridiculous suggestion and threatened to withhold $300 million in highway funds. Oregon begrudgingly complied, but likely felt vindicated in 1971, when the federal government mandated that centerlines now be painted yellow, with white stripes reserved for roads where traffic drove in the same direction. (Lines on the sides of roads didn’t gain traction with officials until the mid-1950s. Before that, edge markings were prohibited. They were finally advocated in 1961, and then mandated in 1978.)

Route Signs

How about when Oregon Department of Transportation spent $680,000.00 to switch out 400 speed limit signs for House Bill 3402 when it passed in 2015 and increased the speed limit to 70 MPH on selected roadways.  At $1,700.00 for each sign…that is some kind of phenomenon speed sign!

If you’re like me, as you ride by a roadway sign, you likely understand the signage on a subconscious level and that’s why the designs were chosen in the first place.

Colored signs were erected along a stretch of roadway in the mid-1950s. The signs led to two cities: Utopia and Metropolis. Drivers were later polled about which sign color they preferred. Green came out on top at 58 percent, followed by blue (27 percent), and black (15 percent).

Many road sign features have interesting origin stories.

IMPORTANT: Riding on painted lines reduces grip when it rains.

REMINDER:  “White lining” is NOT legal in Oregon.  This is the act of lane-splitting or when a motorcycle travels along the white line between two adjacent lanes of traffic.

It’s a reference to a song written by Bob Dylan and released as the title track of his 1964 album of the same name (video). Dylan wrote the song as a deliberate attempt to create an anthem of change for the time. Interestingly, the song addresses no specific issue and prescribes no concrete action, but simply observes a world in upheaval.

“Changes” is a relevant topic as the Oregon Legislature passed hundreds of bills last year during the short summer session.

I won’t bore you with the “Sustainable Shopping Initiative” and the HB 2509 upheaval, but what follows are some changes in 2020 that motorcycle enthusiasts might be interested in knowing more about:

HB 2017 — Vehicle registration fees are a-changin!  In 2020, some vehicle fees in Oregon will be based on miles per gallon (MPG) as part of “Keep Oregon Moving,” a major transportation funding program. If you have an electric vehicle or a car that gets more than 40 miles per gallon, you’ll have two options. You can pay the full fee up front to register or renew your tags, or you can pay a lower fee and a monthly per-mile charge for miles driven in Oregon if you join OReGO. The net-net is, drivers with more fuel-efficient vehicles end up paying more in registration fees. I’ve reached out to DMV for a statement on specific changes related to electric motorcycles and will update this post with any information. SEE UPDATE AT BOTTOM. Oregon is one of a handful of states aggressively pursuing new registration fees (read more tax $$) for electric vehicles, in a preemptive move to capitalize on the shift to electric that is leading to lower gas taxes.

HB 57 — Were you recently pulled over and did the law enforcement officer fail to notice your change of address sticker on the back of your drivers license… which led to an even long(er) traffic stop? Good news!  HB 57 ends change-of-address stickers because Oregon DMV will no longer require stickers on drivers’ licenses, permits or ID cards when people change their addresses. It was estimated that ending the sticker program will save $550,000 a year in printing and postage costs. Those savings will go into the State Highway Fund to “support local and state roads.” Oregon law still requires driver license, permit and ID card holders to update the DMV with a change of address within 30 days of moving.

HB 2015 — Oregon becomes one-of-thirteen other states providing driver licenses for undocumented immigrants. Proponents of extending driver’s licenses to immigrants argue that licensing undocumented residents will lead to fewer hit-and-runs, more trust between immigrants and police, and increased revenue for DMV. Opponents assert that granting licenses to undocumented residents reduces the incentive to follow immigration laws and would lead to increased voter fraud, ID fraud, bank fraud and easier for terrorists/criminals to obtain fraudulent documents.

Whether or not you get twisted up around an ideological axle on this topic is your choice, but Oregon’s HB 2015 — the Equal Access to Roads Act — signed in July 2019, now allows undocumented immigrants to obtain their driver’s licenses, though they still aren’t eligible to vote. While undocumented immigrants don’t have to prove citizenship, they will still be required to pass a driving test, pay a fee, and prove they’re current Oregon residents. House Bill 2015 removes the requirement for individuals to provide proof of legal presence when applying for a driver license or ID card. However, after January 1, 2021, individuals applying for a standard driver license or ID card must still provide proof of full legal name and identity, date of birth, Oregon residency, and a Social Security number. If an individual has not been assigned a Social Security number, they must sign and submit a written statement with their application. The law was passed in 2019 and is only applicable for a standard Oregon driver license or ID card. Important to note is that standard driver license or ID card is not Real ID compliant. All other requirements such as proof of name, identity, date of birth and Oregon residency stay the same.

You might be asking why was this law signed in 2019 if it doesn’t go into full effect until 2021? According to the DMV talking points — they are implementing a number of changes in 2020, including a new computer system and the introduction of Real ID compliant cards in July 2020. Waiting until January 2021 allows DMV to update the technology to accommodate the undocumented immigrants law change. Oregon and 13 other states and Washington, D.C. currently issue driver licenses to individuals who do not provide proof of lawful status.

SB 998 — Oregon passes a version of the “Idaho Stop” law.  SB 998 now allows bicyclists to yield at stop signs rather than come to a full and complete stop before proceeding through an intersection. If you ride a motorcycle in the city of Portland, you’ve likely observed that bicyclists rarely come to a complete stop at stop signs. In 2020, bicyclists now have the option of yielding—rather than coming to a complete stop—at both stop signs and flashing red lights. Red lights still require a full and complete stop, and bicyclists must still yield to pedestrians and right-of-way traffic, and maintain a safe speed.

SB 792 — Do you like spending time at the salvage yard looking for motorcycle projects? Maybe you plan to start “Bill’s Cycle Heap” business this summer? A vehicle dismantler is anyone who takes apart motor vehicles. This often includes recovering, rebuilding, reselling or recycling parts from worn out or damaged vehicles. SB 792 modifies laws related to vehicle dismantler certificates and the plates and registration transfer from totaled vehicles. Notices submitted to the DMV stating that a vehicle has been totaled will allow the transferring of plates and registration from that vehicle to another. The transfer can’t take place if a salvage title was previously issued.

HB 2017 — The thrill of paying more $$ for fuel!  HB 2017 means Oregon’s current gas tax will jump up by 2 cents, the second of four increases approved in 2017. The Oregon Department of Transportation will use some of the additional funds (estimated at $60 million) to improve state roadways, and the remainder will go to Oregon cities and counties.

HB 3452 — U.S. Highway 26 across Oregon is officially designated a POW/MIA Memorial Highway now.  HB 3452 was sponsored by Central Oregon lawmakers.

Gridlock Traffic

With breweries (84 in Portland area), donuts and great bookstores, Portland is a dream to ride around and visit — until you get stuck in traffic.

Allstate Insurance has Portland as home to some of the worst drivers in the U.S., ranked at 181 out of 200 on their list of “Best Driving Cities.”

Not long ago, Portland also landed on a list of the top cities for drunk driving (compiled by QuoteWizard).

Now there is a study, published by Apartment Guide, that showcases Portland in the top-10 list of “The Worst Cities for Commuters.”  The city takes the No. 7 spot as one of the worst cities for commuters.  Number one is Los Angeles and number two is Seattle.  Studies for Portland indicate that in large part the congestion comes from roads and highways that haven’t been expanded to accommodate the large influx of millennial newcomers who have moved into the city/area.

For any of you who have experienced the brutal gridlock traffic and tried to ride around with traffic in Portland, it’s no surprise.

There is good news if you like higher taxes.  In November, the Oregon Transportation Commission sent the Legislature a report (PDF) outlining how ODOT and local governments have met specific requirements in order to trigger gas tax increases.  It’s called The Conditional Motor Fuels Tax Increase Accountability Report.  The report ensures a funding package and that all of the statutory conditions required to trigger the first two-cent motor fuels tax increase will become effective January 01, 2020.

Yea, more gas tax!

If you are interested in the grading of major roads in and through communities (good, fair, or poor) or so riders can see what they’re getting for their increased taxes, check out this website that was developed by ODOT.

But wait, there’s more…

Governor Kate Brown (who theoretically is responsible to set an example for state employees!), flies on a private jet to the Sunriver airport to meet with the Oregon Forest & Industries Council. When the backlash became louder and the media noted that the “green” optics looked rather poor, the governor’s office went on a charm-offensive and provided a ‘PR message’ stating that “the decision to travel by (private) plane was made to accommodate a busy schedule.”

Don’t we all have “busy” schedules?  What does that say about the Brown administrations environmental credentials?

Any reasonable person would view a private jet as being something for the “privileged” few, but it now seems to include state employees.  Don’t get me wrong.  I’m on-board the “Keep Oregon Moving” legislation, but rubbing the voters faces in the my time is more “valuable” and I have the power to fly over traffic congestion seems very tone deaf. Once this became public, Governor Brown’s office stated she would report the private flight as a gift, as required by law.

But, it’s not the only example.  Consider that on October 31st, the State of Oregon Aviation Board (the OAB is appointed by the Governor) members flew by private planes to a meeting in Sunriver for a hearing on the Aurora State Airport runway expansion while citizens who will have to live with the consequences of a decision needed to drive 3 hours each way to give 2 minutes of testimony!  I’m guessing, but if they were confronted I would anticipate their decision to travel by private plane was to accommodate their very “busy” schedule.

Does anything seem wrong about this?

The “do as I say, not as I do” optics are extremely poor given the Governors push for a cap on carbon emissions and her administrations advocacy that citizens need to pay more taxes and make more sacrifices for climate change.

I love planes!  But, private jets are the worst form of transportation if you are concerned about carbon emissions so, please stop lecturing me about climate change and demanding more sacrifices.

As you know, I’m a motorcyclist licensed in the State of Oregon.  I’ve written many blog posts that represent motorcyclists and advocate for the passage of laws that improve motorcycle safety and result in motorcycle awareness and driver accountability.

My perspective comes from years of riding motorcycles and having first hand knowledge of friends who have been injured when drivers don’t see motorcycles and the dramatic consequences.

Speaking of motorcycle accidents, the following are examples of common motorcycle accident causes:

• A car makes a left-hand turn in front of a motorcycle, usually because the driver is not looking for, or does not otherwise see, the oncoming motorcycle.

• A vehicle pulls out of, or into, a side street or driveway, also usually because the driver does not look for, or otherwise see, the motorcycle.

• A car rear ends a motorcycle because the driver is inattentive or distracted, usually by a mobile electronic device.

• And the all-to-common motorcycle accidents involve only the motorcyclist!  There have been a number of motorcycles that inexplicably missed a curve on a clear, dry road and left the roadway.  Many suffered injuries or death after striking a tree, roadside sign, utility pole or boulder.  Be it age related (yes, I said that!), pushing the limit of the riders skills or the capability of the motorcycle, driving impaired — both by drugs and alcohol — or by fatigue and exposure — riders need to constantly tweak riding habits to stay sharp.

In tracking the U.S. states information, searching and following-up on the Oregon data of various motorcycle accidents in the news, it seems that negligent drivers are often not being cited for any violation when they cause a motorcycle accident. Moreover, careless drivers are typically only being cited for routine traffic violations, and reckless drivers are being cited only for careless driving.  I’ve also read about simple cell-phone tickets being cited when drivers cause severe accidents.  If you try and track motorcycle accident cases, they are usually not referred to the District Attorney’s office unless there is a fatality or a drunk driver involved. Careless and even are facing very little to no criminal repercussions for their conduct and instead being given a traffic violation or no traffic violation at all.

That’s all about to change!

Back in 2017, Oregon began to address this issue by passing HB 2598, which expanded Oregon’s Vehicular Assault Statute, ORS 811.060, to protect motorcyclists and their passengers from reckless drivers, making it a Class A Misdemeanor for a reckless driver to injure a motorcyclist or passenger. That same year, Oregon passed SB 493, which made it a Class A Misdemeanor for a criminally negligent driver to seriously injure a vulnerable user.

However, under the current statute, motorcyclists, moped operators, and their passengers are not, even though they are equally susceptible to being directly struck and seriously injured by a careless, or criminally negligent, driver as the other road users.

But, effective January 1, 2020 is Senate Bill 810.  Signed into law back in June, the Bill modifies the definition of “vulnerable user of a public way” to include persons operating or riding on moped or motorcycle.  The law (801.608, “Vulnerable user of a public way”) enhances penalties for motorists who kill or injure motorcyclists, as well as other vulnerable road users such as pedestrians, highway workers or bicyclists.

Oregon has taken an important step to protect riders and their passengers. Oregon now joins the State of Washington along with several other states by treating motorcycles and mopeds the same as other vulnerable road users by significantly enhancing the penalties against careless and criminally negligent drivers.
